Failure to identify

Answered by attorney Kenneth G. Wincorn
DUI/DWI lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
The solution is to amend the conviction records by filing a Motion Nunc Pro Tunc. The attorney you hired to handle the case should be able to get this done for an additional fee.

Can an blood test show more alcohol than a breathalyzer test?

DUI/DWI lawyer at Pietryga Law Office
Possibly. I am guessing that the cop asked for a blood draw because of your low BAC reading. He is hoping you have an illegal substance in your body. Clearly, you were not under the influence of alcohol to a degree that would warrant a conviction. Hope this helps.

Will an out of state probation officer find out about a drunk in public?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
Consult a criminal lawyer. The laws in each state are different from one another, and only a lawyer well-versed in the law of the state in which you on probation can give you a useful answer. That said, if you are asked a question in court, whether or not you are under oath, you have no choice but either to tell the truth, or respectfully refuse to answer.
