It is not a question of being legal or illegal. The question is what exactly did the court approve and is there any reason it can't or shouldn't be changed. The simple answer is that whatever happened was not "illegal" even if it was wrong and, if you agree to change it, there is nothing from going back to court to have that new agreement approved. Even if you don't agree, your ex-husband may be able to convince the court that mistakes were made and to overrule what was erroneously done.

You need a court order saying that the "illegal" marriage was invalid. Otherwise, state records show you married. With a court order, things get "cleaned up".
