Until the marriage is annulled, you are technically married so can file married filing jointly. However, be careful as you don't know whether he's filing with his other wife. Talk to a CPA.

I assume you have not started the divorce process yet.     Are both of you on the deed and mortgage?  If not, who is on the deed and who is on the mortgage?  Are there minor chldren who have lived in the house most of their lives? If she is on the mortgage with you, can she refinance based on her income? Is she a housewife who takes care of the minor children (if you have any)?   Is there equity in the house?  If so, how much? The answers to these questions may assist in determining how a judge would rule in this dispute.

If you have been a resident of the state of Georgia for at least six months, then the state of Georgia has jurisdiction over your status as either married or not married. Whether the state of Georgia has any jurisdiction over the person of your spouse is another question. If she will voluntarily signed papers and submit herself to the jurisdiction of the court, you can have an uncontested divorce in Georgia. You can also have an uncontested divorce and the state of her residence as well as a contested case in the state of her residence. You may or may not be able to have a contested divorce in Georgia depending on whether there is jurisdiction over her person.
