My husband leaves and takes my child and now wants back into the house to collect his stuff what can I do?

Based on your narrative, I am confused regarding the child. ("we both have custodial rights. the child is not a product of the marriage") Are you both biological parents of the child, or just one of you? Regarding access to the rented home, he may legally re-enter the home without your knowledge or permission - just as you could do. Your rights to occupancy are equivalent. The solution is to obtain a court order granting you exclusive right to occupy and prohibiting his entry. Such temporary restraining orders are commonly issued when one party files an action for divorce in order to keep the peace and prevent confrontations. The right of access to the child can be addressed by the court as well.

Is divorce in absentia possible

Christine Marie Santana Bechtold
Answered by attorney Christine Marie Santana Bechtold (Unclaimed Profile)
Divorce lawyer at The Law Office of Christine M. Bechtold, LLC
It sounds like you need an attorney who can act as an uninterested third party to facilitate your divorce. If she does not want to see you anymore, perhaps the two of you could have an uncontested divorce (meaning you agree to the division of your assets and debts). You can theoretically have an uncontested divorce with minimal, if any, direct contact between the parties.  To your specific question, you can have a divorce in Georgia if you cannot find the other spouse, but there are strict procedures for that and it not seen often.

If your divorce agreement includes joint responsibility for past taxes, then she would be liable to contribute for the past taxes.
