In Georgia, you would need to file a Poverty Affidavit. You can find the forms on the Internet. It will be up to the Judge whether to waive the filing fee after reviewing your affidavit.

Did you sign the loan modification? If not, then is presumed to have knowledge of the fact that you do not have ownership interest and agreed to loan modification based on her financial profile. You should not be responsible. Bank approves loan modification upon review of financial information from the homeowner. My presumption is that bank and your ex-spouse followed the right procedure and there is no fraud or misrepresentation. Another issue or question would be if you were on the loan to begin with.

You should talk to an immigration attorney. I suggest you wait to file the divorce until after you have the green card. You can ask for maintenance and a percentage of the community property in every divorce. Your student loan will be your separate debt since you will have all of the benefit of the education. Any other debts that are clearly community debts will be allocated between the two of you. I suggest you get a lawyer.
