If you are awarded some kind of financial support from the divorce, then your spouse is obligated to pay the support awarded and his failure to do so could result in him being found in contempt of the court's order and have the court order him incarcerated until such time as he complies with the court order.

While it may technically be illegal to have a baby out of wedlock, I have never heard of someone being prosecuted for that. It happens every day. Your husband does not have to sign any papers for you to divorce him. Technically, the baby's legal father is your husband because the child was born while you were married, but you, your husband and the baby's father can straighten all of that out in your divorce. Make sure that you do because you want to make sure that the baby's father is legally declared to be the father so he can be financially responsible for the child.
