You can file in the state you are a resident of at the time you seek a divorce. In California, the requirement is that you be a resident of the State of California for six months before filing for divorce, and a resident of the County in which you file for at least 3 months. Even if you don't meet the residency requirement, a work around is possible that will allow you to file now.

Under certain circumstances, a prenup might protect you from his creditors. To be effective against creditors, however, you or your husband must provide them with a copy of the prenup, or otherwise be certain they know of its existence at the time the debt is incurred. Otherwise, the prenup might be valid as between you and your husband, but would not likely be valid against creditors. Of course, if the debts arose before the date of the marriage, you are not liable on them.

Did you have a job before you got married? Do you have an advanced degree? How hard will it be for you to find a job. In Idaho spousal support is only given to get the spouse on his or her feet. Depending on the answers to these questions, you might get nothing.
