Whether you pay him spousal support depends on a balancing of your income against his. Since you say you earn quite a lot more than him, it is probable that you will be ordered to pay spousal support. I strongly urge you to meet with an experienced family law attorney in your community right away to take steps to protect your interests.

What would my legal rights be if the assets were sold when we get divorced?

Answered by attorney Carolyn E Gaston (Unclaimed Profile)
Divorce lawyer at Carolyn Gaston & Associates P.C.
Michigan operates on an "equitable division" of property in divorce. Barring disparity in incomes and many other factors it is likely that the proceeds of any property sold would be divided on close to a 50/50 basis. After 35 years there are a multitude of factors which could impact your outcome. You should speak to an attorney for advise and look at potential spousal support and division of retirement benefit options.

In SC, most likely, your home is marital property that will be equitably distributed by the Court. There are ways in which you can speed up this process on a temporary basis. You should consult with a local family law attorney regarding these matters as soon as possible.
