Do NY Courts allow pre-action discovery motions related to divorce? How does the process work?

Answered by attorney Alfred Joseph Polizzotto
Divorce lawyer at Polizzotto & Polizzotto, LLC
Generally speaking, although there are provisions in the CPLR for pre-action disclosure, your situation would not be ripe for any such relief.  You are seeking to obtain evidence which would potentially give rise to a cause of action for divorce.  Especially in light of the recent developments in New York which give rise to "no fault" divorce on Irretrievable Breakdown of marriage for six months, your discovery is not necessary to commence a divorce.  Your issue is more of a "trust" issue with your spouse and is more likely to be resolved in a marriage therapist arena prior to resorting to a divorce.  - Alfred Polizzotto, III, Esq.

How do you get a divorce in new york state and how long will it take

Kristen Prata Browde
Answered by attorney Kristen Prata Browde (Unclaimed Profile)
Divorce lawyer at Browde Law, P.C.
There is no requirement of a separation. How long it takes depends upon the complexity of the case and the county in which it is filed.

If I divorce and move out of New York will I lose the chance of getting primary custody of my 5 year old daughter

Answered by attorney Seth David Schraier
Divorce lawyer at Law Office of Seth D. Schraier, P.C.
The test that the court in New York applies in all custody cases is what is in the "best interests" of the child.  The fact that you are contemplating moving out of New York does not necessarily mean that you will not be able to win custody of your daugther.   The best way to avoid any complications is to speak with your husband about your desire to relocate with your daughter and work out a written agreement that includes parenting time for the father so he will still feel a part of your daughter's life.  It is recommended, however, that you have an attorney draft any agreement so that it conforms to the law and minimizes any future issues between you and your husband.
