Will I have to pay alimony to my non-working wealthy spouse?

Stephen Marc Drucker
Answered by attorney Stephen Marc Drucker (Unclaimed Profile)
Divorce lawyer at Legal Action Workshop Professional Corporation
I strongly suggest that you meet with an experienced divorce lawyer to discuss your situation as it can be complicated. Assets that are accumulated during the marriage from the date of marriage to the date of separation are usually considered community assets and as such both parties split those assets. The house & the retirement funds are normally considered community property. Spousal support is based on a number of factors, one of which is the differential in income but there are others such as 'need'.  Again, a consultation with an attorney should make clear whether spousal support would be reasonable in your case and what should be done with the house, retirement funds and any other assets that you may have accumulated during the marriage.

Am I entitled to my husband's 401K in a divorce if he started investing in it before we got married?

Answered by attorney Ellen Nichole Smith (Unclaimed Profile)
Divorce lawyer at Smith Horras, PA
In Idaho, all income earned during the course of a marriage is "community" income. In other words, such income belongs equally to both persons in the marriage. So, even though your husband began investing in his 401K prior to marriage, you would generally be entitled to 50% of the portion of the 401K earned after you both were married. The part of the 401K that your husband earned prior to your marriage would be considered his separate property.

If divorced in a state that has a waiting period, does that prevent them from legally remarrying in a state that does not have a waiting period?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
This is not an easy question. In all likelihood the law of the state in which the divorce was granted prevails. But there are no certainties. You could consult an experienced lawyer in your community or the one where the husband lives.
