Usually the person living in the house is responsible for the mortgage because it would cost the same (or more) to live outside the house and pay rent. If he makes substantially more than you do, apply for an order for spousal support with your local court to help defray your expenses. If there are children involved, apply for child support if they are living with you.

Where this would be a factor would be with regards to a possible award of spousal support to him. Such an award wouldf involve the court looking at a number of factors, chief among them your respective earning capacities, your needs, and the needs of any minor kids, but including as factors the extent to which his earning capacity was impaired by his being out of the workplace so he could provide domestic duties (Family Code sec. 4320(a.)2) and to contribute to a spouse's career (sec4320.a.3). So the brief answer is that he is correct that it is a factor, but how much of a factor depends on numerous other variables.
