She is entitled to one-half of all payments made on the condo during marriage so long as those payments were made from earnings and not from gifts or inheritances.

If I'm filing for a divorce, can I stay at the house that we are renting from his mom?

You only have the right to stay if mom will continue to rent to you. If she doesn't, then you will have to leave.

Should I serve divorce papers to my spouse first or move out first?

Answered by attorney Barbara Peyton (Unclaimed Profile)

It shouldn't matter. It might be easier to move out and then have your spouse served. You cannot serve the papers yourself. It must be someone 18 years or older and not related to you by blood or marriage. When papers are served, emotions generally get escalated and a fight can ensue. Moving out first will probably help to de-escalate the situation.
