It invalidates your subsequent marriage on the grounds of bigamy. Finish the first divorce, annul your current marriage, and then remarry after the divorce is finalized. That is the appropriate way to address these issues.

Generally speaking, any portion of your settlement that is for lost wages or property damage is considered "community" and should be equitably divided in your divorce (this usually means equally). Any portion of your settlement that is for pain and suffering is considered "separate" and should not be divided in your divorce.

Most states, such as California are "no fault" states (it does not matter to the court who is at fault for the divorce). Therefore, who wants the divorce or initiates the court proceedings does not really matter. If you have children, make sure you have not abandoned them without making plans for visitation and support, or getting into court right away to have those issues determined, so that it shows your continued care of the children (if there are any children).
