Usually the person living in the house is responsible for the mortgage because it would cost the same (or more) to live outside the house and pay rent. If he makes substantially more than you do, apply for an order for spousal support with your local court to help defray your expenses. If there are children involved, apply for child support if they are living with you.

What does it mean when you file a motion for the judge to uphold the original divorce agreement and they grant you relief?

Ask your attorney. But it should mean that whatever was supposed to happen under the original decree is still supposed to happen.

Voluntarily? I doubt it. By court order, perhaps. It depends upon many factors, and the only fact we are given is insufficient to formulate an answer. The financial circumstances of the parties, the length of the marriage and other factors are considered.
