The court won't dismiss a case until five years from the date the petition is filed. You need to find a process server in Oregon to personally serve your husband with the Shasta County action. If he serves you first with Oregon papers, you will have to deal with the case through the Oregon Court. Not a pleasant thought.

Very, very rarely. Judge may ask but never a party. Sometimes when he child is age 16 or more the Judge will want to hear from them but below age 16 child testimony is rare in a divorce case.

Spouses cannot kick each other out without a court order. If you ask the cops to assist you in re-entering, they will likely do so and insist he give you a new key if he has changed the locks.
