If my spouse put my name in the title of a property, is it then considered marital property?

Answered by attorney Richard Eric Anthony Dwyer
Divorce lawyer at Richard E.A. Dwyer, Esq
You can now argue that your husband made a gift to the community as evidenced by the change of title.

Can my wife take the house once the divorce is granted?

Answered by attorney Jessica M Cotter (Unclaimed Profile)
Divorce lawyer at The Law Firm of Jessica M. Cotter, P.L.L.C.
You have not provided sufficient information to fully answer your question. It appears that you owned the real property prior to the marriage. If you did not put your wife's name on the title after your marriage she will still have a claim for community funds used to either pay for or improve the property. Generally speaking if both of your names are on the title to the property, if you cannot reach an agreement on the disposition of the real property then the court will order it to be sold, and the proceeds divided. You should speak with an experienced family law attorney about your matter.

Yes, depending on the jurisdiction. Generally the divorcing spouses will share equally in the contributions and growth in the value of a pension or 401K accrued during the marriage.
