You can file a Request for Order to compel the final disclosure or ask the Judge to set a date for the disclosure. You can also waive the disclosure if you have enough information and evidence to proceed to trial or settle. In some cases, if the disclosure is not done after a court order, you can ask for an evidentiary sanction or terminating sanction and proceed by default.

If each of you have met the residency requirements in your respective state, then you each have the right to file in either state. You may file in your state but you must personally serve your spouse. If the other spouse files they will need to personally serve you. If there are children involved the state where children reside is the home state. If you and your spouse are in agreement you can save thousands of dollars by agreeing on who files and then stipulating to all the terms of your divorce and submitting the signed stipulation to the court for approval.
