Do you have an attorney? Ask him. Someone must file a motion for alternate service get an affidavit from your process server that indicates when and how they tried to serve him and file the motion.

Your best bet is to call some lawyers and see if any of them have time to see you and draft up a petition in a very short time. Since a snowstorm is on the way, speed may be harder just now than at other times. There are standard forms which you may be able to get from the Clerk of Court in your county. Generally these things are one-size-fits-all, and a lawyer could likely do a better job.

The serve is not valid if you served it. It must be served by someone over 18 not related to you. Have him served again and you will be able to go forward
