You will have have to use your best efforts to locate him using various methods such as post office, DMV and voter registration searches and then you would need to apply to the Court for permission to serve by publication in a newspaper of general circulation in your county

How can a mortgage company be deeded off the property? Your question is very confusing. I think that you must be asking if both borrowers do not consent, can the mortgage company modify the loan. They probably will not, but there are many mortgage companies.
