I was awarded my truck in the divorce. Ex-wife never gave me title and I found out she has now taken a loan out on it. What will be my legal action?

You have to take her back to court to get a court order that she either pay you the truck value or pay off the loan and return the truck to you. If there already was a court order, what she did is probably contempt for which she can be put in jail and/or fined about $2000 in sanctions. You will need a lawyer for this so talk to a good family lawyer in your community before doing anything without a lawyer.

You fell into default. You could be barred from litigating to Judgment. Yes, get legal representation or at least get assistance from the Family Law Facilitator at the Courthouse who is free unless the stakes are zero.

Can we get married again as a way to change our names?

Answered by attorney Barbara Peyton (Unclaimed Profile)

The law at least in California is that you can use any name you want so long as it is not for the purpose of committing fraud. Go to DMV and get a new driver's license. Take your marriage certificate with you. Contact Social Security to make a name change. You should be OK. If that doesn't work you can file an action with the court for a name change but you certainly don't have to get married again. Good luck.
