It depends on what the Legal Separation agreement states. If it awards you the car you can do what you want with it. If it does not award you the car then you can not sell anything with out the joint owners consent. You need to have your paperwork looked at before you make any decision.

There is no definite rule. If his things are not in the way why not give him 60 days to pick up the items or you will sell them. The rule is that they are community property you could be forced to reimburse him half of the value of the property or if they are separate property you would have to pay him their full value.
