There is a lot that your attorney should be able to do for you, but the sooner you take action the more varied your choices, particularly if the situation you describe is a hypothetical; if it has already happened, your choice of actions is more limited but still extensive., up to and including a request for an order that the children be returned and that any property sold be accounted for.

Personal injury settlements are separate property of the injured person. the only way she would have a claim to any of that money is if your case included a claim for loss of consortium. speak to your personal injury attorney about this. You should also talk to a family law attorney in your county about the issue before you enter into any settlement talks with your wife.
