Where do I file for divorce and do we have to involve child custody with the divorce?

You probably need to file in Florida. Virginia does not have jurisdiction yet. You might speak with an attorney there and find out what is possible for you. Since the spouse still lives in Florida, and since your marriage was last intact in Florida it is best to file here. The Court will usually leave raising the children up to the parties, but everything must be in writing, including when the children will be with whom.

Though there is nothing preventing you from changing the locks, you don't have a court order giving you exclusive use and possession of the home, at least not yet. Also, if he has a driver's license showing he lives there, he can easily force his way into his own house, or have a locksmith open the door for him and cut him a new key. If you feel you need exclusive use and possession of the house, the better practice would be to have your attorney ask for it in your pleadings, and obtain a court order. Consult with an attorney to discuss the specifics of your situation and your options.
