Can retirement earned prior to marriage be taken in divorce since I paid 3 out of 33 years to social security while married?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
She can divorce you. You need to file for custody and a move away if you want to take the kids overseas. Calpers is yours. Social security belongs to the earner, so it's yours. Depending on income she may get alimony and child support from you. You can't take kids overseas without court's permission or her agreement.

Am I entitle to anything if I file for divorce

Answered by attorney Andrew M. Lloyd
Divorce lawyer at Lloyd Associates, PLLC
I am unsure whether you have gained residency, based on your inquiry; however, assuming you have - you can file in the county in which you have resided for 90 days (as long as you've been in Texas for 6 mos.) and the adultery issue simply gives argument as to why you should receive more than 50% of the community assets you have acquired during your marriage.  Feel free to contact me with further questions.

Can a mother take her children to another state and then files for divorce there?

Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Divorce lawyer at Graves Law Firm
If you're all Texans for more than six months, Kansas won't have jurisdiction to entertain your divorce/custody case until you and the children have been there for six months, and if the kids are taken there without your spouse's actual or implied consent (or at least without his objection), you'll have a jurisdiction problem even then. This area is full of reasons for caution.
