The portion of your 401k that you already had when you got married should qualify as your separate property. Any increases/additions that happened during the marriage are likely to be treated as community property.

In Texas, your income is community property. Even if you put it in a different account, it is still community property. All courts allow you to get a temporary restraining order that would prevent either of you from emptying any account once the case is filed. Does your wife work? Her income is considered community property as well.

You don't say if what he has to pay you is support or funds that constitute a division of property. If it's support, he can not bankrupt out of it. If it's a division of property that was reduced to judgment, it is treated as a secured priority debt. If he is not currently in bankruptcy, you can go to court on either a motion for contempt (support) or a motion to compel.
