Assuming a Louisiana jurisdiction, fault is not an issue in the resolution of property matters, however it is an issue in spousal support. Is this child support or spousal support that you are currently paying? Any community obligations that you paying should be considered in settlement negotiations and litigation.

Yes, unless the court finds extreme circumstances to warrant a partition of your house. The general rule is that any property acquisition prior to the marriage remains in the possession of the party acquiring it. When you charged the attorney's fees to the card, did you and your ex have an agreement that he would pay it back? Also, it is important to see how your divorce decree addressed debt specifically and in general. If the decree assigns debt to each of you in a certain way, that would determine how strong of a case you would have against him. Generally, you can certainly go after him for the debt, but whether you can make a valid claim would depend on the above and other factors.
