Would a prenup protect me in my marriage?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
Under certain circumstances, a prenup might protect you from his creditors. To be effective against creditors, however, you or your husband must provide them with a copy of the prenup, or otherwise be certain they know of its existence at the time the debt is incurred. Otherwise, the prenup might be valid as between you and your husband, but would not likely be valid against creditors. Of course, if the debts arose before the date of the marriage, you are not liable on them.

Do I need to appear in court if my attorney filed a motion to withdraw from my divorce case?

default-avatar
Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
No, generally you do not have to appear unless you intend to oppose the motion. You should check with your assigned judge's online information, or call their judicial assistant, to be sure though.

Can I divorce an illegal immigrant and request alimony? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
There is no law known to me which protects an undocumented immigrant from being subject to an award of maintenance (= alimony). Whether you can actually collect it from him is another story. Retain an experienced family law attorney to advise and represent you.
