Will I get half of the house if I file for divorce even if it is under my husband’s name?

default-avatar
Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
Maybe, maybe not. It appears that the house, or at least a significant part of its net value, is marital property regardless of the fact that it deed only to your husband. All marital property must be fairly divided, but that does not mean each and every asset is divided - the final result requires looking at the overall, big picture. If you and your husband cannot agree after discussing the issues with an attorney, the judge will have to decide; there are only three possibilities: you keep the house and buy him out; he keeps the house and buys you out; the house is sold and the proceeds split.

Is there anything that I can do legally against my ex husband who is harassing me from prison?

Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
You don't describe what the harassment is, but a good starting place is with the corrections facility in which he is incarcerated. If the harassment is by telephone, you can block the number(s) from which he calls, decline to accept his calls, screen the calls through an answering machine, or even change your number and make sure your new number is unlisted. If the harassment is by mail, don't open or read them, or leave them unopened and mark them "return to sender" and put them back in the mail. If the harassment is threatening in nature, then you can turn the matter over to the State Attorney's office for possible prosecution. If you have obtained any type of no contact order against him in any prior criminal, family or other court litigation, you can return to that court for sanctions due to his violation(s).
