Why am I not receiving anything from the courts if I am not represented?

It sounds like you should speak with an attorney in CA for legal advice.  When a divorce is filed here, you need to be served. If you returned the proof of service you then had 30 days in which to respond. You have a divorce with issues, namely child support, custody & visitation. You may have other issues. If you did not 'respond' within the 30 day period, then the divorce will end in default which may not be in your best interest. If you and your spouse are in agreement, you would have to sign and notarize a Marital Settlement Agreement or Stipulation which would state the child support amount and specify visitation and custody. In the service packet, you should have had an 'income & expense' and 'assets & debt' blank disclosure forms that needed to be filled out by you. In addition, these disclosure forms, filled out by your spouse, should have been in the service packet as well.

make sure all disclosure documents are filed then file a memo to set the case for trial. The court will then set your case for a mandatory settlement conference and trial. Lawyers at the court will help with the mandatory settlement conference.

Would judge give her the house and impose alimony on me?

default-avatar
Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
It sounds like there should probably be no spousal support because your incomes are so close. That answer is based on an assumption that your numbers are correct. She is entitled to one-half of all payments made on the house for the mortgage principal or improvements during your marriage. You will probably need a lawyer. These kinds of cases get a little tricky.
