How do I claim my portion of my ex husbands retirement?

Cathy Rose Cook
Answered by attorney Cathy Rose Cook (Unclaimed Profile)
Divorce lawyer at Cathy R. Cook, Attorney at Law
You have to present a QDRO to the company. This QDRO has to be prepared as a separate document in your divorce and signed by both parties and the court. Then, that is submitted to the company. Once they accept it, you are guaranteed receiving your share when your ex retires.

Can I file request for judgement myself for my divorce even though I was represented by the lawyer?

Fire your current attorney and hire a better one. Discuss you previous representation with your new counsel, the new attorney might ask to have your fees returned, or that you file a grievance with the Bar Association. As for the case itself, the file with the court should be reviewed to determine what the hang up is.

How do I complete my divorce, when ex fails to complete final papers (ordered by judge)?

Divorce lawyer at Ludwig Law Center
That is a tricky question. If your ex has filed a response or petition, then you have to file a Motion to Strike the pleading, and the file a request for default.
