Who owns the house

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
The property and the children are two different matters. The divorce decree governs on both issues, but you will notice that the house is in one seciton fo the decree and the children are in a totally different section. If you got the house in the decree, the house is yours. A later agreement about the house is not enforceable. He would need to file some type of modification to change the propery division concerning the house. As to your possession and access to the children, that should be enforced through a suit to enforce access and possession. It's a totally separate issue than the house. If your ex-husband has engaged in parental alienation, that should be addressed with the Court as well.

Can a judge force me to remain in business with my husband?

Answered by attorney Violet Ikeanyi Nwokoye (Unclaimed Profile)
Divorce lawyer at The Nwokoye Law Firm
No, the judge will not force you to go into business or remain in business with anyone, however when a divorce is pending the judge can order what happens to a community property, income or business if the parties do not have an agreement. Since this is a family business, the sale will not be just your decision to make if a divorce pending.

Is Texas alimony state, and if I'm filing divorce does my spouse have the right to stay in our home/apartment while divorce is in process??

Charles Sanders
Answered by attorney Charles Sanders (Unclaimed Profile)
Divorce lawyer at Rose Sanders Law Firm
Texas is not a alimony state.  Texas has spousel maintainece under certain situations; ie been married for more than 10 years; spouse suffering from a disabiliy; married for more than 10 years and spouse lacks the ability to be self sufficient.   In Texas, when a divorce is filed the spouse does not have to leave the marital home.  You might be able to obtain a "kick out" order under certain circumstances.
