It doesn't matter how title is held. What matters is what money was used to pay for the house. You are entitled to reimbursement for the value of the house on the date of marriage; the community (you and your wife) are entitled each to one-half the appreciation or depreciation in value which occurred during the marriage. You will need a lawyer to help you handle this aspect of your divorce the line of cases which covers the issue is called Moore-Marsden.

In that you were induced into signing the prenup under fraudulent circumstances, the prenup is probably not valid. You should send him a writing telling him that you no longer consider the prenup to be valid. Upon divorce the Texas court can divide all the parties' properties. Sometimes an additional action is required in another jurisdiction to give the Texas Order full faith and credit and/or foreign recognition.

If signatures were required from a spouse in order to get divorced, then that would give one spouse dominion over the other in perpetuity. Slavery was outlawed, so no. This is no different than forcing someone to a trial who denies any wrongdoing.
