When married your father in law gives your spouse stock in a company. Can this be divided during a divorce in Florida

If the stock is kept separate and not mixed with other assets, and your name is not added then it is technically a non marital asset.  IF your husband has paid in money or contributed other assets to the business, then you may have a claim. However a gift that is kept separate is normally not considered marital

Is it okay to begin dating 5 months after you have been kicked out of your home and are getting a divorce?

Divorce lawyer at Ronald Bornstein, Attorney at Law
Florida is a no-fault divorce State, so generally, it will not be relevant whether or not you are dating if the dating did not begin until after the separation or after the divorce was filed with the court. That said, discretion would generally be best exercised and keeping a low profile as well. Introduction of third parties into the dynamics present in a divorce is generally not a constructive thing. You should also check with your divorce attorney and discuss the specifics of your situation, and your options.

Can my ex take my dog?

default-avatar
Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
If the divorce papers are silent on who gets the dog, it may still be an open issue, depending on the precise language of your final judgment and any agreement (if any) made a part of it. It is generally not a good idea to use self-help to recover property, and in Florida, pets are considered to be personal property and are subject to equitable distribution like any other marital property, if they were acquired during the marriage. There can be exceptions, like for service dogs, and sometimes gifts, but generally bills of sale, registrations, license and tag information, vet records, etc., may support a claim that the pet belonged to one party or the other. Consult with an attorney to discuss the particulars of your situation, and your options.
