   First, you will not "get in trouble."  I am assuming when he reopened the account your name was still on it.  He should be "in trouble" for leaving you without any support.     Typically during the pendency of a divorce, the parties are supposed to maintain status quo that existed, financially, before the divorce was filed.  However, in your instance, nothing was filed yet.  That means he can continue to run up debts that you may be partially liable for and deplete marital assets that otherwise you would  be entitled to a portion of. Therefore, since you have nothing "in writing" to make his promises to make certain payments binding, it may be time for you to file for divorce.  However, you say you were married in Florida.  If you are not still living in Florida, you would typically file the divorce action where you last lived together. Your boyfriend can re-mortgage the home into his name alone. To have the deed changed he will have to get his ex to sign a Quit Claim deed over to him. If he truly does not know where his ex is living, he can ask the court to quiet title in his name and put a legal advertisement in the paper to that effect, giving her an opportunity to respond. If she doesn't respond within a specified amount of time, then the court will remove her name from the title or cause the register of deed to issue a new title in his name only.
