Yes there are consequences!!! Do not fail to answer unless you are willing to give the other side a default judgment and everything that they are asking for in the summons and complaint! Consult a local lawyer and go over the documents before failing to answer!!!

It's not impossible: you have to do a diligent search, which probably means hiring either an attorney or a private investigator - and, if that search is unsuccessful in locating the missing spouse, you can seek court approval for alternative service, most often by publication.

Since you were married in New York, you do not have to be in the US to start a divorce action against your husband in New York as long as he lives in New York and has lived there for a year prior to the start of the divorce action. A copy of your marriage certificate (not license) is necessary for the divorce and can usually be obtained from the office of the clerk of the county or village where the marriage took place.  You don't have to do that yourself- it can be ordered online or you can authorize your attorney to obtain it for you. In the event the divorce is contested and depositions and/or a trial are necessary, and application can be made to the court to conduct your deposition remotely by telephone or otherwise.
