In New York, if a divorce has commenced, the portion of the pensions of the parties that were accumulated during the marriage are considered marital assets subject to equitable distribution.  In other words, they are subject to being divided.  The fact that one spouse is working and the other is unemployed will normally not effect any such distribution of assets.  However, if it is shown that there is in effect, "marital waste", which was resulted from one parties refusal to seek employment, then potentially there may be a distribution of those assets which is not equal and favors the party who accumulated the pension benefits. If there are not enough factors to establish "marital waste", then the pension will be distributed in the proportions determined by the Court.  New York is not automatically a 50/50 division state, i.e. not community property, but the longer the marriage, the close the Court will likely find to such a 50/50 split. There are other factors which should be looked at in dividing pensions such as survivor benefits and choice of options in selecting pension options at retirement. An experienced attorney specializing in matrimonial law should be consulted before any actions are taken. - Alfred Polizzotto, III

How olde are the children?  Are they living with you in PA.? If they are living with you in PA for over 6 months, and are not emancipated, you can file for child support in PA. If you want to re-open the divorce in NY because you were never served, you can do so by motion.
