Getting a divorce, only asset a house and bank account, she used my information to open credit cards which are maxed out and unpaid, drain account .

Answered by attorney Lori Nevias
Divorce lawyer at Lori Nevias, Attorney at Law
Assuming you both own the house, when it is sold (or when the bank account is split), the divorce agreement should provide that the credit card charges as well as the value of the jewelry (if you can prove it) come out of her share. If she doesn't agree, and wants to litigate, you will ultimately get a credit for the money she cost you. Write letters to the three credit agencies and explain the circumstances, and it could help your credit.

What can I do to contest the divorce and attempt to get her to reconcile and save the marriage?

California is a no fault state so no actions included in your question would qualify as a reason to prevent your wife from receiving half of the community estate. If one spouse wants a divorce you can only mark a box on the Response that you believe the marriage is not over. Otherwise if your wife wants a divorce there is nothing in the law that will prevent her from moving forward.

Finding a new attorney

Kristen Prata Browde
Answered by attorney Kristen Prata Browde (Unclaimed Profile)
Divorce lawyer at Browde Law, P.C.
To find a new lawyer should be relatively easy. The first question: where is your case pending? Is a judge already assigned? If so (and I'd assume after three years, there is a judge assigned) you would want to choose someone who has some experience before that judge, or in the alternative, considerable experience in the matrimonial field. Discuss with potential candidates the issues that are unresolved and what the problems have been with your first attorney. When you find someone with whom you feel comfortable you can decide whether that person is right for you. Once you've decided and hired someone new the process is quite simple. The new attorney will prepare a document called a substitution and file a Notice of Appearance.
