You can file a Petition for dissolution at any time. If you dismissed the Petition before, I would suggest that you consult with an attorney. Usually a party cannot exert the same type of pressure that s/he did on a spouse. Additionally, if there is an issue of your spouse escalating, you should discuss that with an attorney so you two might formulate a plan for your protection.

The wife can be compelled to give DNA samples, and the child's can be taken following the birth. The divorce can be granted prior to the birth, but the issue of responsibility for the child will have to be reserved.

If you signed a Marital Settlement Agreement, then you may be out of luck. If he took a default Judgment against you, without your signature on an agreement, then you can perhaps file a motion to set aside the Judgment on grounds of fraud. You need to speak with an attorney about this, as your case sounds like it will be complicated and you will need the help.
