You can file a Petition for dissolution at any time. If you dismissed the Petition before, I would suggest that you consult with an attorney. Usually a party cannot exert the same type of pressure that s/he did on a spouse. Additionally, if there is an issue of your spouse escalating, you should discuss that with an attorney so you two might formulate a plan for your protection.

The court does not automatically know you signed a prenuptial agreement. If it is enforceable, it is up to you to assert your rights under it in the divorce proceeding. The money your husband is currently making is community income, and you may be able to get a court order for temporary support, including attorney fees, in order to make sure you and your child are properly looked out for in the proceeding.

One, she or you will have to sign off the title. Two, you will have to get the loan company to agree. If the loan was made based on both your incomes, that is doubtful.
