The fastest you can get divorced in Colorado is 91 days after he is served with the petition for dissolution of marriage. The fact that he is in Georgia does not make a difference. However, to be finished in 91 days will require his cooperation. If he does not cooperate to get his financials filed and sign a separation agreement and couple other steps, it can drag on (generally no more than 6 months though in a case like yours). A lawyer can be helpful in cases like this by knowing the process and keeping the process moving forward to get you done as soon as possible.

You can call the clerk of the court to ask for copies of the papers. Depending on the process he used, he may be able to ask for money. You could make him start over if you could prove he lied when he filed stating he did not know where you are. If he only wants a decree of divorce and is not asking for any money, then you might be best off going through with it, as it?s not a good idea to remain married to someone with questionable behavior, since there are always some risks to you being his spouse. As well, if he wants a divorce, the court is going to grant it, as they will not force people to stay married, so it probably is in your best interest to go along with it if only to ensure your rights are protected. A lawyer in Colorado, like me, can enter an appearance, review the case, talk to him and help you get though it. If the case is uncontested (i.e., he is not asking for money and you are not either), it would not be expensive to have us help you (likely under $1,500).

If she is working and you are not, you will have a good change of getting temporary maintenance. You have to ask for a temporary maintenance hearing at the initial status conference. You can ask as part of temporary maintenance for money to pay for an attorney for you, as the courts want the parties to be on an equal footing (i.e., make it a fair fight). If the two of you make less than $76,000 per year, there is a presumptive formula the court uses to come up with a temporary maintenance amount, otherwise it is based on what you need to meet your reasonable needs.  The court actually can order her to pay all of your attorney fees at the end of the case. You definitely should speak with an attorney, especially if she has one, as it's harder for men to get maintenance because of reverse sexism, but it's definitely doable. Hope this helps.
