What are the rights of a wife after 7 years of marriage if husband wants a divorce?

Depends. If the restaurant was acquired during the marriage, wife has an interest. If the husband had an interest in the restaurant before the marriage, and his stake did not change during the marriage, wife may not have an interest. The presumption in Nevada is that everything acquired during the marriage, no matter how it is titled or held, is community property subject to equal division. Wife needs to consult with an attorney to get a more clear picture of her rights and responsibilities, and she needs to do this before any divorce action is started.

As a US citizen, what will happen to my child if I divorce my husband who just got his visa?

Answered by attorney Austin M. Hirschhorn (Unclaimed Profile)
Divorce lawyer at Austin Hirschhorn, P.C.
If your husband is the father of your 3 year old daughter and you divorce him he would be responsible along with you to support the child. If he got his visa based upon his marriage to you and the immigration authorities determine that the marriage was only entered into to assist him in getting citizenship he could be deported. If he is not the father of your 3 year old daughter, he would have no obligation to support her and based upon your age and the short duration of the marriage it is unlikely that you would be awarded spousal support if you were to divorce him.

Am I obliged to return the engagement ring if we are a having divorce due to his anger issues and aggression?

The engagement ring is a gift which is contingent upon a subsequent marriage. Once the marriage takes place, it is a completed gift to the recipient. You are not obliged to return the ring.
