Can the attorney be paid through settlement at the end of case or does my husband pay since there is a big income difference?

Your attorney can petition the court for an advance of attorney fees based on the disparity in income. There is law in place in California to try to give both parties equal access to the courts by equalizing income and attorney fees.

If one spouse is given exclusive occupancy of the home, how can they get the other spouse removed?

The police absolutely should enforce it, just as they should enforce every court order. She should file an emergency motion asking the judge to find the husband in contempt. Also, I suggest calling the Chief of Police and, if necessary, the State Attorney. There is no reason for a police officer to refuse to enforce such an order.

No, generally those items, and I would need to know more than you have written, which are acquired after separation, are not considered marital assets.
