Marriage is a civil contract but it is a unique form of contract. Because of the unique relationship established by marriage and its social and economic implications, the state is very interested in the creation, interaction and dissolution of this contractual relationship. Therefore, marriage is governed by New York statutes.  Marriage between two parties establishes an economic partnership, and the state is very much involved in regulating and monitoring the mutual economic responsibilities of the married partners.  Each spouse is therefore primarily responsible for his or her own debts, and the other spouse responsible only if he or she pledged payment and had the ability to pay  This is true with or without divorce.  If you have not pledged payment such as by being a co-signer on her credits cards, for example, then you need not worry about her running up debts. If you wish to divorce, then do so, but the debt issue should not be your sole determining factor.  Please consult with an attorney in your area experienced in these areas of law before undertaking any course of action. - Alfred Polizzotto, III

This is a very complex question. All of the facts regarding purchasing the property need to be known. What was the intent, the agreement (if any), why was the property only in your wife?s name. You need to discuss these facts with an attorney as one-half the equity in a house is at stake.

Much more information is needed before your question can be answered. What stage is your divorce? Do both parties have attorneys? Has a divorce settlement agreement been signed by all the parties and their attorneys? Has the "packet" of divorce papers been submitted to the clerk for review before it goes to the judge to sign the decree? Or is it with the judge? Or are there outstanding papers that need to be drafted and signed?  Even in this age of no-fault divorce and even in an uncontested divorce, there is a mountain of paperwork that needs to be submitted to the court before the decree is signed by the judge. Once that paperwork is submitted, it is appropriate for your attorney to make periodic calls to the clerk to ascertain the estimated time before the papers will be reviewed by the clerk or the judge, depending on the stage. If corrections need to be made, the clerk will inform the attorney or party who submitted the papers. Once you answer these questions, you'll get a more helful answer.
