How do I get a court date for a final divorce hearing when all the paperwork is done and we had a mutual agreement on everything?

Answered by attorney John Joseph Stanton (Unclaimed Profile)
Divorce lawyer at The Law Office of John J. Stanton
If both of you have appeared (One filed a Petition, the other filed a Response), then you need to file an At-Issue Memorandum. If only a Petition was filed, you can file a Request for Default and proceed that way. I would suggest that you both first sign a Stipulated Judgment. Contact the Self Help Center at the courthouse for the forms and assistance completing them.

Once I file for divorce am I entitled to a portion on that inheritance?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Divorce lawyer at R. Jason de Groot, P.A.
He has what is known as a special equity in the inheritance from the mother. This is an asset that has nothing to do with the marriage and, unfortunately, you do not have any claim to it. If it is a long term marriage, however, you may be able to assert a claim for alimony and prove that he has the ability to pay alimony. So, there are many ways to skin a cat. Get an attorney who knows how.

Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
If you are in Florida, any debt incurred during the marriage is marital debt, no matter whose name it is in. You should consult with an attorney to assist you in your divorce.
