The family court does not entertain immigration issues. Your stepmother can request temporary spousal support. Generally, spousal support lasts for 1/2 the length of the marriage.

It sounds as if you have done all you can. You should be able to get duplicate w-2s from you employer, do that and file now, See an attorney and get a divorce now. It is very doubtful any of his demands will be granted.
