Child support can only go back until the day that the request for child support is made with the court. If you file on August 1st, but the hearing isn't until October, the Judge may order that he owes you for August, September and October, but no further than that. If he never paid your attorney fees pursuant to the court's order, you should bring a motion to get him to pay as soon as possible. You could also file for Contempt of Court if you think you can prove that he had the funds available to him and chose not to follow the court's order.

On the one hand, if the money can be traced with some clarity, then it could be regarded as separate property. On the other hand, in a 20-year marriage, the court is fairly likely to determine that it is all community property. Consult an experienced divorce lawyer with all the relevant facts.
