The judge can force you to refinance if your ex is liable on the mortgage.. It affects his credit rating and his ability to finance a new home. SO If you cannot get the existing mortgage company to release his liability (and your divorce judgement does not affect them) you must refinance it or sell it.

In Arizona you would file a petition for dissolution, have him sign an acceptance of service, then the two of you sign a consent decree to submit to the judge. Both of you must pay the assigned fee. There is a self service center at most superior court facilities, or you can go online for forms and instructions.
