In Louisiana you may obtain a divorce for any reason or no reason, simply because you want one. If a spouse has committed a felony and is sentenced to hard labor, the other spouse may obtain an immediate divorce. The divorcing spouse can prove their case with a certified copy of the minute entry showing the conviction and sentence of the defendant spouse. If the convict spouse is not sentenced to hard labor, the divorcing spouse must wait the required waiting period. In the case of no children that waiting period is six months. You should contact a divorce attorney immediately to discuss your specific case and circumstances.

In Arizona there are rules in the statute about relocating more than 100 miles. You must either have the agreement of the other parent, and you should get that in writing, or you need an order from the court. I you have an attorney assisting you with the dissolution he or she will be able to advise you. If you do not have an attorney I suggest you at least consult with an experienced and local family law attorney to talk about this.

Unless your husband does so voluntarily, you will have to pursue the divorce in order to divide the account and have the court enter a QDRO (Qualified Domestic Relations Order). Depending on the terms of the Plan, you husband may not even be permitted to make any withdrawals without a QDRO and even if he can, he won't get the tax and penalty waivers that occur when the withdrawal is due to divorce.
Unless your husband does so voluntarily, you will have to pursue the divorce in order to divide the account and have the court enter a QDRO (Qualified Domestic Relations Order).
