What are the steps if I want to file for divorce and my husband is incarcerated but we have nothing to contest?

Answered by attorney Tracy Torni Gaudenzi (Unclaimed Profile)
Divorce lawyer at Beier Howlett, P.C.
Same steps as if he were out of jail. You can still get divorced; however, he still needs to be served. Different jails/prisons provide various methods for service. You will need to contact them to find out how to serve him properly.

When is a house a community property?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
Maybe. It depends on whether it was used as the marital home, was community property used to pay the mortgage and maintenance and how long did the people live there as husband and wife. If only 6 months, probably not. 20 years, probably yes.

House is my husband’s name and been married for 27 yrs can I still get part of the value of the house from him?

Annette M Cox Sandoval
Answered by attorney Annette M Cox Sandoval (Unclaimed Profile)
Divorce lawyer at Cox Sandoval Law, PLLC
If the house was purchased after you were married, then it is community property subject to equitable division. It does not matter that it is titled in his name alone provided you did not sign a disclaimer deed. There could also be a claim if the house has increased in value over the course of the marriage, even if it was purchased prior to the marriage.
