Can I get alimony and sole custody of our children if I divorce my husband?

You have provided insufficient information upon which to make even a determination. Custody and spousal support are determined in Michigan based on a number of factors. The fact that your husband has been unfaithful may be germane but that alone will not be determinative. You clearly need to engage in attorney to assist you in ending this tragedy.

What will now happen on the home equity loan?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
Your fact statement is a bit difficult to unravel in terms of separate and community property. Separate property is owned prior to the marriage and community property is acquired during the marriage. The court cannot award separate property to the other spouse. If you owned the house prior to this marriage, it is your separate property. With respect to the equity loan, the creditor will sue the parties who signed the note. I suggest you hire a lawyer.

If I sold my car, is my spouse entitled to the car?

Bruce Provda
Answered by attorney Bruce Provda (Unclaimed Profile)

If you were only on the title and her name wasn't and you've already sold it there's no getting it back now. The money you received though would be joint marital assets.
