How do you have a divorce dismissed

Answered by attorney Ronda Elizabeth Harris
Divorce lawyer at Harris Law Firm, PLLC
You can file an agreed Motion to Dismiss (signed by both parties).  However, if no action is taken on the case, then the Court will eventually set the case on its dismissal docket.  If no one shows up for the dismissal hearing to argue as to why the case should be retained on the docket, then the Court will dismiss the case without need of any further action by the parties.  Keep in mind, the downside of waiting for the Court to dismiss could mean months and months of waiting.  The time frame is different for each Court depending on the Judge and the Court's docket.

How can I get signing a document about a pension reversed?

default-avatar
Answered by attorney Erin Patricia Farley (Unclaimed Profile)
Divorce lawyer at Law Office of Erin Farley
I can not answer this question without seeing what paperwork you signed. If you have doubts, I suggest you immediately call the plan and get the information from them. Find out what you signed and (if needed) withdraw your consent in writing. (Keep a copy!) Consult with a family law attorney if necessary.

How long does dismissing a filed uncontested divorce decree take to go away if she does nothing?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
If no answer was filed by you in the divorce (which it probably was not, as you claim it was uncontested), your case will be dismissed by the courts in about a year's time for want of prosecution. At that point, your case would be dismissed and closed, so if you decided to pursue divorce again, you would have to start the case from the beginning.
